This agreement sets out the terms and conditions ("Terms") that govern your access to and participation in The ASL Membership ("Membership") facilitated and run by Scherise Saskia ("We," "Us," or "Our").

These Terms are a legal agreement between you ("You" or "Your") and Us, and by completing the online application form and paying to join Our Membership as a member, You agree to be bound by these Terms. It is important that You read these Terms carefully before applying.

You may apply to become a member by completing the application form on Our website at https://www.theaslmembership.com/ ("Website").

You agree to provide accurate, current, and complete information about yourself as requested or directed on the Website and to promptly update this information to maintain its accuracy. We have the right to suspend or terminate your Membership if We suspect that such information is inaccurate or incomplete.

Attendance and participation in The ASL Membership is open only to persons aged above 18 years, and You must have the necessary power and authority to enter into these Terms.
You acknowledge and consent that part of Your Membership includes recording (in audio and/or video format) Your participation in The ASL Membership, where You may feature prominently. These recordings are for the purposes of providing the Membership and for Us to use in Our promotional material to market the Membership. You acknowledge and agree to Our use without restriction, including but not limited to Our ability to use, modify, alter, publish, reproduce, or distribute such recordings.

Your Membership commences when Your application has been accepted by Us, and You pay the price as displayed on Our Website and in accordance with these Terms ("Membership Fees").

We may review, approve, or deny Your Membership application at Our sole discretion.
Your Membership continues until terminated in accordance with these Terms.
To access The ASL Membership and use the services, You are required to create an account, and in doing so, You must give Us accurate information, including Your name, Your business name (if applicable), address, a valid email address, and telephone number. You must be at least 18 years old. You warrant that any information You provide during the account setup process is accurate and correct at the time You provide the information, and that You will update the information if there are any changes. You will be solely responsible for the activity that occurs on Your account, so keep Your account password secure.
We reserve the right to:

1. Limit the number of applicants and subscriptions; and/or
2. Suspend or cancel Your account at any time, at Our sole discretion, including if You breach any provision of the Terms or applicable law or where Your conduct impacts Our reputation.


Membership Fees

Annual Subscription
You will pay Us the Membership Fees as advertised on Our Website in full upfront, and the subscription will renew automatically at the end of twelve (12) months, and Your debit/credit card will be charged the Membership Fee stated on the Website at the time of renewal. Please note that renewal pricing may differ from Your initial price.

Monthly Subscription
Where You have selected a monthly option, You will pay Us the Membership Fees as advertised on Our Website, and the subscription will automatically renew each month on the anniversary of Your joining The ASL Membership program, and Your debit/credit card will be charged the Membership Fee. The Membership Fee amount may change upon renewal of Your subscription.

If You do not pay Us any portion of the Membership Fees when due, Your Membership may be cancelled, suspended, or You may be refused Membership entitlements and benefits until all outstanding amounts are paid.

You must inform Us immediately if Your payment details change. If payment is declined, Your access to The ASL Membership will be suspended until payment has been updated, and You must pay all monies due.

We reserve the right to increase Our Membership Fees in Our sole discretion. However, where You have purchased a subscription to Our Membership prior to the Membership Fee increase, the initial price You purchased at will remain the same. If, however, You cancel Your Membership and decide to purchase a new Membership subscription, You will incur the increased price.

Membership Free Trials
If signing up for a free Membership trial, Your card details are obtained, but will not be charged until the trial period ends, provided You do not cancel Your Membership. To avoid being charged at the end of the free trial, You must cancel Your Membership before the trial ends by following the prompts after clicking "Your Account." If You do not cancel Your Membership after a free trial, Your card will be charged, and You will begin a paid Membership, maintaining access to Membership content. If You wish to continue Your Membership after a free trial, You do not need to do anything once Your trial ends.

Cancellations and Refunds
Annual Subscription
If You would like to cancel Your annual Membership, You may do so at any time. You must provide at least 14 business days' written notice prior to Your renewal date to prevent the automatic renewal of the Membership. The Membership Fee is non-refundable except as required by law. We do not provide refunds simply because Your situation has changed or You have changed Your mind. If You are not 100% sure about a 12-month commitment, We suggest You consider Our monthly subscription and upgrade to Our annual subscription at any time.

Monthly Subscription
If You would like to cancel Your monthly Membership, You may do so at any time. You must provide at least 5 business days' written notice prior to Your renewal date to prevent the automatic renewal of the Membership. Once cancelled, You will not be charged following that date. If You fail to provide sufficient notice or no notice, You will incur a Membership Fee for the next billing cycle which is non-refundable. We do not provide refunds simply because Your situation has changed or You have changed Your mind.

Due to the nature of digital products, we do not offer refunds for any digital product orders, including those related to the Membership. However, if you receive the wrong digital product or if the download link provided is not working, please contact us at https://aslmembership.com/contact-new and we will rectify the situation at no extra cost by providing the correct digital product or an alternative download link.

Membership Benefits and Activities
During your Membership, we will provide you with specific Membership entitlements and benefits as communicated from time to time. Please note that the Membership Fees are payable irrespective of whether you utilize your Membership entitlements or benefits. We cannot guarantee the availability or duration of these entitlements and benefits.

Third-Party Services and Content
As part of the Membership, we may include access to third-party services and content. However, by utilizing these entitlements, you acknowledge and agree that we do not guarantee the accuracy or quality of such third-party services or content. We shall not be liable for any issues or damages arising from the use of such third-party services and/or content.

Membership Duration and Notice
Your Membership will remain active until terminated in accordance with these Terms. In the event that we decide to discontinue or terminate the Membership, we will provide you with at least 30 days' notice. We also reserve the right to cease the online group associated with the Membership with 7 days' notice.

Complaints Procedure
We strive to provide excellent service. If you have any concerns or wish to raise a complaint, please submit your complaint through our Contact Us form. Your complaint should include your name, the email address you used to apply for the Membership, details of your concern or complaint, details of what you would like us to do to resolve the matter, and any relevant correspondence. We will acknowledge your complaint within 3 business days and aim to resolve it within 14 business days. If we are unable to address the complaint within 14 business days, we will provide you with an update on the progress of your complaint.

Prohibited Use of The ASL Membership
In addition to any other prohibitions as set forth in these Terms, you must not use The ASL Membership, Membership entitlements or benefits, the Website, or any content provided to you through the Membership:
1. For any unlawful purpose;
2. To solicit others to perform or participate in any unlawful acts;
3. To violate any international, federal, or state regulations, rules, laws, or local ordinances;
4. To attempt to change, remove, deface, hack, or otherwise interfere with the Website or any displayed material or content on the Website;
5. To hack into any aspect of the Membership, corrupt data, or cause annoyance to other users;
6. To infringe upon the rights of any other person's proprietary rights;
7. To send any unsolicited advertising or promotional material, commonly referred to as "spam";
8. To attempt to affect the performance or functionality of any computer facilities accessed through the Website or your Membership.

Intellectual Property Rights
Regarding the Membership Materials:
1. We retain ownership of all Intellectual Property Rights (including Moral Rights) in the Membership Materials;
2. You are granted a limited right to use the Membership Materials as part of your Membership, strictly for the purposes outlined in these Terms;
3. You are prohibited from modifying the Membership Materials;
4. You must not sublicense, publish, sell, or provide the Membership Materials to third parties;
5. If you provide testimonials, we may use them for promotional purposes.

Intellectual Property Consent and Indemnity
You represent and warrant that you own the intellectual property rights in any content (Member Content) you provide to us, or you have a valid license to use and distribute the Member Content. You will indemnify us against any loss, liability, claim, or demand (including reasonable legal fees) arising from any breach of intellectual property rights related to our use of the Member Content.

By submitting your application and participating in our Membership, you grant us a non-exclusive, irrevocable, royalty-free, perpetual license to use, modify, adapt, reproduce, or communicate your Member Content to the extent required to provide the Membership.

We may terminate the Terms with immediate effect by giving you written notice if:
1. You fail to pay the Membership Fees when due;
2. You fail to comply with any provisions of these Terms or breach any undertaking, warranty, or obligation under this agreement;
3. Your conduct is injurious or potentially harmful to our reputation;
4. You disclose Confidential Information without consent;
5. You fail to conform or abide by our applicable rules, policies, or procedures;
6. Your actions are contrary to our interests;
7. We believe that mutual trust and/or confidence no longer exist.

If we terminate your Membership, we may, at our discretion, refund any prorated balance of the Membership Fee already paid by you.

Disclaimer, Warranties, and Indemnities
You acknowledge and agree that:
1. The Website, Membership, and content are provided on an "as is" basis;
2. You use the Website and Membership at your own risk;
3. You are responsible for maintaining the security of your account and access to the Website and Membership;
4. The information and advice provided during your Membership are for educational purposes only, and no warranty or condition of any kind (express or implied) is provided, including fitness for a particular purpose or guaranteed results;
5. We do not provide legal, tax, or other professional advice. Seek expert advice before acting on any information provided;
6. Individual results may vary, and we cannot guarantee specific outcomes or success;
7. We will not be responsible or liable for any loss or damage resulting from your Membership, except as expressly permitted by law and set out in these Terms;
8. We have obligations under applicable consumer protection laws, and if we fail to meet those guarantees, we will take appropriate action to rectify the situation.

Confidentiality and Privacy
Both parties agree to keep confidential the Confidential Information of the other party, except where disclosure is required for performing the Terms or exercising a party's rights, required by law enforcement agencies, or relates to publicly available information or information received from a third party without breach of any obligation of confidence.

Privacy is important to us, and we are committed to protecting your personal information. When you apply for Membership, we collect and use your personal information strictly for the purposes of providing the Membership and marketing to you with your consent. You and we agree that we are independent contractors, and nothing in these Terms creates a partnership, joint venture, agency, or employment relationship. You must not hold yourself out as being entitled to contract, make representations, or bind us.

These Terms, along with Our GDPR Policy, online group rules, and disclaimers, constitute the entire agreement between You and Us regarding the subject matter and supersede all previous agreements, understandings, and negotiations, whether oral, written, or electronic, pertaining to the Website, Your use of the Website, Membership, and Your use of the Membership.

The Terms will be governed by and construed in accordance with the English law. The parties irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute or claims which may arise under or in connection with this Agreement. Both parties submit to the non-exclusive jurisdiction of the courts of that jurisdiction.

We reserve the right to change these Terms or modify Membership benefits or entitlements at any time. If there are any changes, we will provide you with the updated version of the Terms.
